Supreme Court renders Modi-backed ED Chief's extension “illegal.” Amit Shah and the opposition enter into a war of words

Image
On July 11th, the Honourable Supreme Court went against the Modi Government's decision by annulling Enforcement Directorate Chief Sanjay Mishra's extension. The Supreme Court bench rendered Sanjay Mishra's tenure extension illegal because it went against their previous verdict. Sanjay Kumar Mishra's successive extensions got brought to the Court's attention through petitions moved by opposition leaders like Randeep Singh Surjewala, Jaya Thakur, Mahua Moitra, and others. The Supreme Court Bench headed by Justice B. R. Gavai held that Mishra could hold on to his office up to July 31st at most, during which the Modi Government must ensure a “smooth transition in the larger public interest."  The previous judgments by the Supreme Court on the matter Back in 2021, the Modi Government had, via the Central Vigilance Commission (CVC) Act and the Delhi Special Police Establishment (DSPE) Act, made amendments to the necessary laws to safeguard the extension of the tenure

India’s 160-year-old Defamation Law: Yet another tool for the system to shun dissent and criticism?

Image
Usually, when an institution tries to evade criticism and accountability, they try to gag the voice of the dissenters by using numerous loopholes in the legal system. In India, however, where we get distinguished as the world's largest democracy, certain laws themselves are loopholes to reduce the credibility of the entire framework. One such law is the criminalization of "defamation’’ (मानहानि in Hindi). In the legal context, "defamation" is a term that gets used to penalise a group of people or an individual for deliberately slandering another person's (usually, a famous and respectable individual) or a community's reputation with the aim of personal benefit or to cause economic and social disadvantage to the concerned authority or individual.  While the Constitution of India enshrines the Right to Speech and Expression under Article 19, the Indian Penal Code (IPC) has two sections: 499 and 500, that limit the justifiable extent of the aforementioned funda

From “Amritkaal” to “Kartavyakaal,” why does the Government keep lodging its duties on the people?

Image
Prime Minister Modi made an unexpectant announcement. PM Modi, who appeared to be the poster boy for India's Amritkaal (a period to denote India's growth post-75 years of Independence), has coined a different term to replace the former. India need not crave any "Amrit" (Elixir) from the Government but keep battling the hardships of inflation and unemployment as their "Kartavya" (Duty). That's right, Indians have entered Kartavyakaal until 2047. In the 25 years to come, let us not whimper under the unnecessary pain and hardships for securing the basic amenities of life but convince ourselves that the Government is doing all it can (without any substantial proof for the same) to gift us "Achche Din."  Why expect the Government to deliver perfect governance? The onus is on us, the people of India, to pay taxes and still do more "Kartavya" to pay for the Netas' subsidised canteens and luxurious Bungalows. We must not demand answers

From a 'caged parrot' to a 'vulture on leash', how ED has become a tool for a Political Witch Hunt

Image
A public petitioner appealed before the Honorable Supreme Court, seeking its judicial activism on Enforcement Directorate (ED) Chief Sanjay Mishra's questionable tenure extension for the third time under the BJP Government.  The Supreme Court bench headed by Justice B.R. Gavai, Justice Vikram Nath, and Justice Sanjay Karol had to ask the Center's Solicitor General Tushar Mehta if the fated retirement of a senior bureaucrat would bring the entire agency's functioning to a pause. Yet, there was a mild apprehension in his answer to the question. Sanjay Mishra, the former Chief Commissioner of the Delhi Income Tax Department, was elected as the ED Chief in 2018 for two years. Amidst severe allegations posed by the Opposition Parties against his functioning with the agency, the Government gave the senior bureaucrat a one-year extension in 2020. An NGO sensed foul play and filed a petition before the Supreme Court, but it got ratified.  ED Chief Sanjay Kumar Mishra In November 20
